Rotator Cuff Tear

Our client suffered an injury to her right shoulder. Her symptoms persisted so she was referred to an orthopaedic consultant. The consultant advised our client that she required surgery to repair the tear which was performed.

Our client was not counselled about the risks and benefits of the procedure or about alternative treatment options.

Despite regular physiotherapy after the surgery our client continued to experience poor shoulder movement and significant pain. These symptoms continued so our client sought a second opinion. The surgeon was extremely critical that our client had undergone such an extensive procedure for a relatively small tear. Subsequently, our client had also developed a frozen shoulder and required further surgery.

Our client went on to have several surgeries to her right shoulder and her left as the over reliance on her right shoulder caused symptoms in her left shoulder.

The hospital continued to deny liability despite strong evidence that:

  • our client was not consented appropriately for the surgery and would have opted for conservative treatment (physiotherapy) if she had been advised of it and
  • that substandard care was exercised during the surgery.

both of which resulted in our client experiencing continued restricted movement, significant pain and the requirement to have several surgeries.

Despite this Moosa-Duke Solicitors managed to achieve a settlement for our client.
