Delay in diagnosis of cancer

Our client was diagnosed with testicular cancer for which he had one of his testes removed. He continued to be monitored by the hospital which included regular blood tests and scans.

He was always informed that his blood tests and scans were normal. However, after one of the scans he was informed that the cancer had spread to a node and that this had been visible on a scan 8 months earlier, but it had been missed and he had been told that the scan was normal. The node had grown during the delay.

Our client suffered an 8 month delay in diagnosis of the cancer recurrence and underwent chemotherapy and radiotherapy. During this time he experienced pain, nausea, fatigue and diarrhoea.

The Trust admitted that the node should have been picked up on the first scan and Moosa-Duke Solicitors therefore achieved a settlement for our client.
