Timescales

To make a claim if your loved one has died due to medical negligence, you have 3 years from the date of death.

If there is a claim under the Human Rights Act 1998 in relation to the death of your loved one, the deadline to make the claim is 12 months from the date of death.  It is important that you contact a specialist medical negligence lawyer as soon as you feel able to do so after the death of your loved one, in case there is a claim under the Human Rights Act 1998
