Timescales – For Bringing A Claim.
When a loved one has been injured, or someone has passed away, the main priority is never usually bringing a compensation claim. However, it would be remiss of us not to mention that there are strict time limits.
Any injury or death is upsetting. The last thing on a family’s mind is contacting lawyers but it is important to bear these timescales in mind.
1 Year:
If there is to be a claim under the Human Rights Act (HRA) a claim must be started before the one year anniversary of a loved one’s death.
3 Years:
If there is no claim under the HRA then you have three years from the date of death.
If the claim does not concern a death, then the 3 years is as a general rule, from the date of injury.
If the claim involves children or where there has been brain damage resulting in a lack of capacity, the timescales are different.
