Introduction

Mr TA, who was previously employed as a bed salesman, a part-time Funeral Director and an occasional Freelance Butler, had always been in good general health. After multiple failures over a 4 year period.


Mr TA underwent an amputation of his leg.  


He required aids and equipment, adaptations to his home, adaptive footwear, prosthetics, rehabilitation, and adaptations to his lifestyle. He suffered depression and his mental and emotional health were affected as well his personal relationships and employment.


His upper limb was affected through use of a wheelchair and he also required a number of surgeries which were as a result of the negligence.


A keen horse rider, he was unable to ride for a number of years.

What Happened?

Mr TA experienced increasing pain around his left ankle together with instability and functional restriction. Examinations confirmed he had large osteophytes and tilting of the talus. Mr TA’s symptoms were increasingly getting worse.

A year later he had an operation to fuse the ankle.  It was admitted that this fusion operation was performed below standard, and the screws inserted were incorrectly placed. Pain and instability and swelling continued and mobility was restricted and he required crutches to walk.  He was under follow up but he was discharged before recovery.  It was admitted that he was negligently discharged from care despite this.

2 years later there was a further operation to fuse the ankle.  Mr TA had had an infection in his ankle just before this surgery.  It was admitted that it was not appropriate to carry out surgery so soon after the infection.
