Knee replacement surgery leaves husband in constant pain
The Injury
Mr F was a keen sportsman in his youth and was a carer for his disabled wife. He had a longstanding history of knee pain and agreed to undergo a knee replacement.
Following the surgery Mr F was in continuous pain and, despite extensive physiotherapy, was unable to walk without pain. He was also concerned that his leg was fixed at an odd angle.

Our legal experts have successfully resolved many surgery compensation claims where negligent surgery or complications related to surgery have occurred both in an NHS or private hospital setting. While all surgery carries a degree of risk, some damage or injury to patients should simply not occur and our team will work with the relevant Trust or healthcare provider to ensure that lessons are learned and future errors prevented.
If you or a loved one has been affected by a delay in diagnosis or treatment we can provide legal representation on a no-win-no-fee basis [hyperlink to a funding page] to investigate a compensation claim, seek justice and secure your or your loved one’s future.
What Happened?
Mr F had a longstanding history of knee pain and after knee replacement surgery found himself to be in continuous pain. Despite extensive physiotherapy, he was unable to walk without pain. He was no longer able to continue his responsibilities as his wife’s carer and was unable to independently deal with activities of daily living.
Mr F subsequently underwent revision surgery, which noted an infection requiring lengthy treatment with antibiotics. Sadly, Mr F continued to experience ongoing pain his knee, although he was able to resume his carer responsibilities and independent activities of daily living.
Investigation proves negligent knee replacement surgery
Mr F sought a second medical opinion privately and was informed that the initial knee replacement had been carried out negligently and that the leg was misaligned. We then obtained independent expert medical evidence which confirmed that the knee replacement had indeed been carried out negligently resulting in a mal-alignment of the leg.
How We Can Help?
We can help you investigate your case, and recover compensation for your physical and psychological injury together with the cost of future treatment, rehabilitation, loss of earnings (if unable to work as a result of the injury), vital aids and equipment and for any care or support that is required as long as it can be attributed to the negligence.
The outcome for our client
MDS Medical Law specialist solicitors represented Mr F and secured an admission of liability (fault) from the relevant Trust for negligently performing the original knee replacement and recovered a five-figure sum in compensation.
How can MDS Medical Law help ?
Although a knee replacement is intended to improve mobility and quality of life, negligence by a clinician during the procedure can have the opposite effect. Similarly, there may be a fault in the manufacture of the implant or inadequate post-operative care.
Our legal experts have extensive experience of dealing with these types of claims and will be able to provide expert advice and guidance to identify and address all relevant issues.
