Elderly gentleman dies in a residential home
The injury
Mr J suffered a deterioration in health whilst an inpatient at a hospital. His health worsened further after being discharged into an unsuitable residential home, where he eventually died.

What Happened?
On the advice of his GP, Mr J was admitted to hospital. On admission he suffered with various conditions, including Parkinson’s Disease, urinary incontinence, hypertension (high blood pressure), chronic kidney disease, poor mobility and period of confusion and memory loss.
During the 4 weeks that he was an inpatient Mr J suffered 2 pressure ulcers on his sacrum (at the base of his spine).
Whilst in the residential home Mr J’s pressure ulcers persisted, his confusion increased, and he suffered significant weight loss.

Our investigation
After extensive review of the relevant medical records and on receipt of expert medical evidence, it was maintained on behalf of Mr J’s Estate that there was a failure in the management of his discharge from hospital. Specifically, that the Trust did not adequately assess the needs of Mr J prior to discharge, and they also failed to engage with Mr J’s family and Social Services.
As a result of these failings Mr J was discharged to a residential home that was ill-equipped to cater for his nursing needs.
With the correct management Mr J would have been discharged to a residential care facility equipped to meet his needs. He would not have suffered a deterioration in his health, which hastened his death.
The outcome for our client
The claim was originally defended by the Trust and a long battle ensued. After starting Court Proceedings the claim was eventually settled and compensation was given to the family of Mr J.
