DVT Mr Burgin Died 2 Weeks After A Hip Replacement
Mr Burgin, who was a Formula 1 engineer and aged only 48, died 2 weeks after a hip replacement operation.
Mr Burgin suffered a fatal pulmonary embolus following a DVT.
Mrs Burgin contacted us to represent her at an inquest and also to make a claim for negligence, because she was concerned that there was a failure to diagnose the DVT during a stay at Leicester Royal Infirmary and also when her husband was seen by his physiotherapist at Spire Hospital, Leicester.
As part of our investigations our specialist team represented Mrs Burgin at the Inquest into Mr Burgin’s death.
Because of the complexity of the case, the inquest took place one year after Mark’s death and the claim for negligence, which was defended throughout, was eventually settled 5 years after Mark’s death for a significant sum.

What Happened?
Background: Mr. Burgin, a 48-year-old male, underwent a left uncemented total hip replacement surgery on 16th December 2014 at Spire Hospital due to long-standing hip issues. His medical history included a family history of pulmonary embolism (PE) following deep vein thrombosis (DVT) in his father and a previous hip surgery at the age of 16.
After Surgery: Following surgery, Mr. Burgin received daily Fragmin (Heparin) injections for prophylaxis against venous thromboembolism (VTE). Initial post-operative assessments did not reveal any signs of DVT or PE. However, on 3rd January 2015, he presented with left-sided calf pain, foot discoloration, and systemic symptoms suggestive of a possible DVT.
Hospital Admission: Concerned about DVT, Mr. Burgin was admitted to Leicester Royal Infirmary. He continued to experience calf pain and systemic symptoms, leading to suspicion of infection. Despite treatment, his condition did not significantly improve.
What happened after Discharge?: On 7th January 2015, Mr. Burgin was discharged with antibiotics for suspected infection and initiated on prophylactic Dalteparin due to high-risk status for DVT. His symptoms persisted post-discharge.

The Fatal Incident
On 16th January 2015, Mr. Burgin experienced severe breathing difficulties and cardiac arrest. Efforts to resuscitate him were unsuccessful, and he was pronounced dead at Leicester Royal Infirmary.
Post-Mortem
The post-mortem examination identified the cause of death as a massive pulmonary embolism secondary to deep vein thrombosis originating from the left calf.
Lessons
Mr. Burgin's case underscored the critical importance of adhering to VTE prophylaxis guidelines rigorously post-operatively. The delay in recognizing and treating his DVT contributed to the fatal outcome despite subsequent medical interventions. This case emphasises the need for heightened awareness, early detection, and timely intervention in managing post-operative complications such as VTE to prevent adverse outcomes.
The Legal Case
Mrs Burgin and her son were represented at the Inquest by MDS medical negligence specialist team.
A legal claim was also pursued against the University Hospitals of Leicester NHS Trust.
Liability was initially denied.
Damages were eventually agreed to settle the claim after 4 years.
